General Provisions (Applies to all Guarantees)
Management Continuity:
All guarantees are contingent upon a continuous, active Management Agreement between Owner and Broker. Should the Owner terminate the Agreement for any reason, all guarantees are immediately null and void.
Non-Transferable:
These guarantees are provided exclusively to the Owner of record at the time of lease signing. They do not transfer to new owners in the event of a sale or to any other properties owned by the Owner.
Good Standing:
Owner must be in good financial standing with poker, with no outstanding balances or unpaid invoices, for any guarantee to be honored.
Compliance with Recommendations:
Guarantees are void if the Owner overrides Broker’s professional judgment regarding tenant selection, maintenance requirements, or legal compliance.
30 Day Rental
Guarantee
The Promise:
If Broker does not secure an executed lease and a security deposit for the property within 30 days of the Listing Start Date, the Broker will waive the Management Fee for the first full month of the lease.
- Listing Start Date: The 30-day clock begins only when the following three conditions are met: (1) The property is vacant and "Rent-Ready" as determined by Broker; (2) All keys/access codes are provided; and (3) The Owner has approved the Broker’s recommended Market Rent price.
- Price Adjustments: If the property remains unleased after 10 days, Owner agrees to a price reduction of 5% or more if recommended by Broker. Refusal to adjust the price voids this guarantee.
- Seasonal Exclusion: This guarantee is not applicable to listings initiated between November 1st and December 31st due to holiday market stagnation.
Pet Guarantee
The Promise:
Broker will reimburse the Owner for physical damage caused by an authorized pet that exceeds the amount of the Security Deposit, up to a maximum cap.
- Coverage Cap: The maximum reimbursement under this guarantee is $1,500.00 per tenancy.
- Authorized Pets Only: This guarantee applies only to pets screened and approved through Broker’s third-party screening portal.
- ESA/Service Animal Exclusion: This guarantee does not apply to Service Animals or Emotional Support Animals (ESAs) as defined by the Fair Housing Act; these are legally considered "animals," not "pets," and no pet fees/rent are collected for them.
- Exhaustion of Deposit: Owner’s claim will only be paid after the entire Tenant Security Deposit has been applied to pet-related damages first.
- Exclusions: Does not cover "normal wear and tear," flea infestations, or yard/landscaping damage.
Eviction Protection
Plan
The Promise:
Broker will cover the basic legal and filing costs if a tenant placed by the Broker must be evicted for non-payment of rent.
- Coverage Cap: Reimbursement of court filing fees and standard attorney fees is capped at $1,500.00 per occurrence.
- Placements Only: This applies exclusively to tenants screened and placed by the Broker. It does not apply to "inherited tenants" or tenants placed by the Owner or a prior management company.
- Exclusions: This guarantee does not cover:
- Lost rent or past-due balances.
- Physical eviction costs (e.g., locksmiths, movers, or "set-outs").
- Costs associated with a Jury Trial or contested litigation beyond a standard summary proceeding.
- Evictions resulting from the Owner’s failure to maintain the property in a habitable condition.
Leasing Guarantee
The Promise:
If a tenant placed by the Broker fails to fulfill the first 12 months of their lease (via eviction or unauthorized lease break), the Broker will waive the Leasing/Placement Fee for the subsequent tenant.
- Lease Term: Only applies to initial lease terms of 12 months or longer.
- Unauthorized Breaks: Does not apply if the tenant vacates legally under the Service Members Civil Relief Act (SCRA), via a court order, or if the Owner and Tenant mutually agree to terminate the lease without Broker's consent.
- Owner-Initiated Sale: Void if the tenant vacates because the Owner decides to sell the property or occupy it personally.
- Replacement Process: Broker will perform all standard marketing and screening for the new tenant. Owner remains responsible for any third-party costs (e.g., professional photography or premium advertising upgrades).
